Petition for Justice in Housing Communities: End Mismanagement, Corruption & Abuse in Apartment Associations
We, the undersigned residents, homeowners, and concerned citizens, raise our collective voice against the widespread and alarming abuse of power, financial mismanagement, and lack of transparency within countless housing associations across India and abroad.
From major cities to small towns, apartment complexes that were meant to be safe havens of community living are instead being governed by opaque, unaccountable associations that have turned into power centers—fueled by corruption, nepotism, and a complete disregard for the welfare and safety of residents.
📌 The Problem
1. Financial Mismanagement
Unaccounted corpus funds, inflated service charges, misuse of maintenance fees, and zero transparency in accounting practices have become the norm in many residential associations.
2. Safety Hazards
Critical infrastructure like fire safety equipment, lifts, generators, and water systems are neglected—despite heavy resident contributions. In many cases, lives are put at risk due to poor maintenance and lack of qualified technical staff.
3. Unethical and Unlawful Practices
Favoritism and nepotism in awarding maintenance contracts, inflated billing, hiring unqualified staff, and conflicts of interest in vendor selection are disturbingly common.
4. Suppression of Dissent
Residents who question these irregularities often face intimidation, harassment, or public defamation—resulting in a climate of fear and silence.
5. Lack of Accountability
Basic governance practices like publishing minutes of meetings, financial statements, or providing access to association records are routinely ignored, violating state housing laws and resident rights.
🗣️ Our Demands
To ensure safety, fairness, and transparency in housing communities, we demand:
1. Area-Level Regulation
Standardized maintenance pricing norms should be enforced—not just state-wide or city-wide, but area-wise, based on infrastructure and real operating costs.
2. Mandatory Third-Party Audits
Annual audits of association finances by accredited external firms should be mandatory, and reports must be made digitally accessible to all residents—anytime, anywhere.
3. Democratic Resident Representation
Residents should have equal and fair representation in all decisions. Transparent elections, regular meetings, and grievance redressal forums must be enforced by law.
4. Simplified Legal Redressal
Residents should not be forced to navigate complex legal systems. A fast-track, online grievance portal should be set up under state housing authorities or RERA for association-related complaints.
5. Legal Penalties for Corruption & Negligence
There should be clear and enforceable penalties—including financial and criminal liability—for those found guilty of fraud, mismanagement, or endangering resident safety.
6. Open Access to Filed Documents
All documents submitted by housing associations to authorities—such as registration certificates, compliance reports, and AGM resolutions—should be accessible via public portals.
